This is an appeal from a judgment for $11,100 damages including a $500 attorney’s fee, rendered by the circuit court of Christian county in favor of appellee against appellants, in a suit in assumpsit heard by the •court without a jury.

The first count of the declaration is upon a promissory note for $10,000 payable to the order of “Mary E. Hitchcock, heirs, C. A. Hitchcock, agent.” The third count alleges the execution by the plaintiff of a certain contract for the benefit of the defendant Vincent E.
