In an action to recover damages for fraud and breach of contract, the plaintiff appeals from an order of the Supreme Court, Nassau County (Janowitz, J.), entered October 1, 2013, which granted that branch of the defendants’ motion which was pursuant to CPLR 3211 (a) (3) to dismiss the complaint.

Ordered that the order is reversed, on the law, with costs, that branch of the defendants’ motion which was pursuant to CPLR 3211 (a) (3) to dismiss the complaint is denied, and the matter is remitted to the Supreme Court, Nassau County, for a determination of that branch of the defendants’ motion…
