Appeal from that part of an order of the Supreme Court (Burns, J.), entered June 29, 2015 in Broome County, which partially denied plaintiff’s motion for summary judgment.
Defendant was formerly employed by plaintiff as the Director of Parks and Recreation and, in that capacity, was entrusted with the collection of various fees and funds on plaintiff’s behalf. In April 2014, defendant pleaded guilty to grand larceny in the third degree, admitting that he stole more than $50,000 from plaintiff between January 2007 and November 2012.
