This action was brought to obtain a perpetual injunction against the defendant, restraining it from diverting the waters of a portion of the Wynant’s kill, in the city of Troy, along the land of the plaintiffs, and to compel the defendant to restore to their natural bed or channel, the waters of the kill, diverted by the defendant.
