Martin Sanbria-Bueno, a Mexican citizen, was convicted of conspiracy to possess with intent to distribute and to distribute heroin in violation of 21 U.S.C. § 846. Following his sentence, but while still on supervised release, he was removed from the United States. Three years later, he was again arrested in the United States for a drug offense. He pled guilty to illegal reentry.

At sentencing, the district court concluded that Sanbria-Bueno’s prior conviction for conspiracy to commit a federal drug offense was a “drug trafficking offense” as defined in…
