I. Introduction and Procedural History
In 1991, the Bank of New England Corporation (“BNEC”) filed a petition for relief under Chapter 7 of the Bankruptcy Code, 11 U.S.C. §§ 101 et seq. Dr. Ben S. Branch serves as Chapter 7 Trustee of the BNEC bankruptcy estate. On May 23, 2001, he filed with the bankruptcy court a motion for an order authorizing a fourth interim distribution from the estate for the benefit of certain creditors.
