The unfortunate accident occurred on a paved highway known as Primary No. 10 running east and west through Franklin county, Iowa. The highway at the place of the accident is eighteen feet, 3 inches wide, and has a level dirt shoulder on each side of the pavement about six feet wide. There are two black lines in the center of the pavement. Between the outer edges of these lines is twenty-two inches, and between the inner edges the clear space is ten inches.

The accident happened about seven p. m. on December 12, 1931, at a point on the highway about 1,500 feet easterly of plaintiff’s home. It…
