OPINION OF THE COURT

MANSMANN, Circuit Judge

William Weatherwax appeals from an order dismissing, without an evidentiary hearing, his petition for writ of habeas corpus filed pursuant to 28 U.S.C. § 2254. In this petition Weatherwax alleged that both his trial and appellate counsel failed to provide him with effective representation. We center on the claim that trial counsel failed to request a voir dire to determine the impact on the jury when one of its members brought a newspaper article concerning Weatherwax's trial into the juryroom.
