Stuart I refers to Stuart’s direct appeal, S.Ct. No. 14865. The opinions of the Court in Stuart I ave found at 110 Idaho 163, 715 P.2d 833. Stuart II, S.Ct. No. 17014, refers to the March 1989 opinions of this Court on Stuart’s appeal of the district court’s denial of post conviction relief. However, the March 1989 opinion was withdrawn, a March 1990 opinion was also issued and withdrawn, and now the October 1990 opinion stands as the Stuart II opinion for the majority.
