R. Lawrence Buzard, the defendant, was convicted of murder in the second degree in the Court of Oyer & Terminer of Jefferson County. He has appealed to this Court.

The victim, Waldo Ditty, and defendant were in disagreement concerning the payment of a lumber bill of about $31.00 which defendant alleged that the victim had not paid.
