The present proceeding involves the same questions which were decided by this court in its former opinion in this case (144 Misc. 854). They concern the taxability under the New York Estate Tax Law of tenancies by the entirety created prior to the year 1916 of realty located in this State. The former proceeding was an appeal by the executors from the pro forma taxing order based on an appraiser’s report which included this real property *382in the gross estate.
