*670The accused was indicted jointly with Boy Raby for the murder of Craig Futrell, and on the trial of the accused he was found guilty of murder of the second, degree, and sentenced to the penitentiary for ten years. There were two trials of the case, but on the first trial the jury were unable to agree on a verdict and were discharged. At the second trial the accused offered no evidence in his own behalf, and he was convicted on testimony for the Commonwealth substantially as follows:
