Rosales-Perez v. Holder

Court of Appeals for the First Circuit

1Opinion of the Court

LYNCH, Chief Judge.

Oscar Orlando Rosales Perez (Rosales), a Guatemalan teacher who entered this country in 2003, was ordered removed in 2011. He did not seek judicial review of that order. Rather, he sought to reopen before the Board of Immigration Appeals (BIA) a few months later based on new evidence. The BIA was unpersuaded. He now petitions for judicial review of the BIA’s denial of his motion to reopen removal proceedings. We deny his petition for review, as the BIA did not abuse its considerable discretion in this area.
