The Court has before it the motion for summary judgment filed by the Town of Orford (hereinafter, “Town” or “Defendant”) and the objection thereto and cross-motion for summary judgment filed by Thomas and Sally Patton (hereinafter, “Pattons” or “Plaintiffs”). In support of the Defendant’s motion, an affidavit was filed, supported by Exhibits B through PP, which are referred to in this opinion.
