Appeal by defendant from a judgment of the Supreme Court, Kings County (Lodato, J.), rendered December 9, 1981, convicting him of robbery in the first degree, upon a jury verdict, and imposing sentence. The *344appeal brings up for review the- denial of that branch of defendant’s pretrial motion as sought dismissal of the indictment (Leone, J.).

Judgment affirmed.
