The Circuit Judge erred in sustaining the defendant’s demuiTer' and in dismissing the bill. The allegations of the bill, if sustained by proof, make a case entitling the complainants to a recovery as prayed. That there could not properly be a recovery at law upon the contract of insurance in its present foam as made to Eudora O.
