This case arises out of an automobile accident. The jury returned a verdict of $37,000 actual damages in favor of the respondent Kenneth E. Ellison against the appellants Robert L. Pope and Ronald W. Stacey, Jr. The questions on appeal relate to the admissibility of certain evidence challenged as hearsay, the denials of Pope and Stacey’s motions for a directed verdict and judgment notwithstanding the verdict on the issue of contributory negligence, the reference to and use of certain written statements claimed to be confidential and undisclosed by Ellison in answer to Pope and…
