In an action, inter alia, for a judgment declaring that certain of the defendant’s buildings *440violate the Zoning Ordinance of the City of Glen Cove, the plaintiffs appeal from kn order of the Supreme Court, Nassau County (Dunne, J.), entered August 22, 2001, which granted the defendant’s motion to dismiss the complaint.

Ordered that the order is affirmed, with costs, and the matter is remitted to the Supreme Court, Nassau County, for the entry of a judgment declaring that certain of the defendant’s buildings do not violate the Zoning Ordinance of the City of Glen Cove.
