Proceeding pursuant to CPLR article 78 (transferred to this court by order of the Supreme Court at Special Term, entered in Albany County) to review a determination of the Commissioner of the State Department of Agriculture and Markets which permanently revoked petitioner’s domestic animal health permit. In September, 1979, petitioner entered into a stipulation with the Department of Agriculture and Markets wherein petitioner agreed not to contest certain allegations of the department concerning petitioner’s engagement in several frauds involving animal disease requirements.
