Appeal from the court of the parish and city of New-Orleans.

The defendants are sued as endorsers of a bill of exchange drawn in their favour, at ten days sight, by the quartermaster general of the United States in New-Orleans, on the secretary of state, for the service of government. The bill was presented in due time, at the office of the *91secretary, where the chief clerk wrote thereon “Presented, and will be paid whenever congress make the necessary appropriation-G.G.” At the expiration of the ten days, and days of grace, the bill was protested for non-payment, and due notice given to the defendants.
