Plaintiff claims title as the sole heir of her mother, Lois A. Ashby. Appellees allege that Lois A. Ashby died leaving a will, the tenth paragraph of which is as follows:

“Tenth. I give, devise and bequeath, in trust, to John Weighton and his successors as trustee, for the uses and purposes and upon the conditions hereinafter set forth all of the real estate situated in Audubon county, Iowa, except my homestead, if any, of which I may die seized and possessed.
