Appeal, by permission, from an order of the Supreme Court (Ferradino, J.), entered December 11, 1996 in Fulton County, which, in a combined proceeding pursuant to CPLR article 78 and action for declaratory judgment, denied respondents’ motion to dismiss the petition as time barred.
The facts in this matter are not in dispute.
