Certain of the reasons of. appeal are based upon claimed errors in the finding, and errors in refusing to find as requested by the defendant. The court did in effect find as to performance as requested by the defendant, though not in the same language. As to the other matters complained of in this respect, it is the ordinary case of conflicting evidence where the defeated party is dissatisfied because his evidence was not believed.
