CHRISTIAN, Judge.

The offense is murder; the punishment confinement in the penitentiary for ten years.

Appellant shot and killed J. E. Saunders. Several months before the homicide deceased and appellant had had some trouble over the-fact that appellant’s stock would enter upon deceased’s premises. According to- appellant’s testimony deceased had killed a mule belonging to appellant and had shot one of appellant’s fine hogs.
