Scheffel & Co., P.C. v. Fessler

Kenneth Fessler, a certified public accountant who was a shareholder and officer at Scheffel & Company, EC. (Scheffel), first appealed to this court after the trial court denied his motion to invalidate a covenant not to compete imposed by Scheffel when a majority of Scheffel shareholders voted to “involuntarily retire” Fessler.
