THOMPSON, Circuit Judge.

This is an appeal from a judgment of the District Court for the Eastern District of Pennsylvania upon a verdict for the plaintiff below. The plaintiff brought suit in. trespass against Fred Dominie and Thompson-Starrett Company to recover damages for personal injuries sustained as the result of an alleged willful, malicious, wanton, and unprovoked assault and battery committed upon the plaintiff by Dominie.
