Marstok, J:

The bill in this case was filed to restrain the defendant from practicing hife profession of physician and surgeon at Maple Eapids and -vicinity contrary to the terms of an oral agreement alleged to have been entered into between the complainant and defendant in August, 1872.

Complainant in his bill alleges, that he is a physician and surgeon, and that about the eighth day of August, 1872, he entered into an agreement with the defendant, who was then a resident and engaged in the practice of medicine and surgery at Maple Eapids, whereby the defendant, in consideration of the sum of…
