Appeal from that part of an order of the Court of Claims (Lyons, J.), entered May 23, 1990, which denied the State’s motion for summary judgment dismissing the claim.
On March 12, 1986, claimant, an inmate at Clinton Correctional Facility in Clinton County, was examined by a physician’s assistant at the facility’s infirmary following complaints by claimant of lumps on both sides of his neck.
