MEMORANDUM AND ORDER
DITTER, District Judge.
A1 Kinkle was convicted of conspiracy to possess a controlled substance with intent to distribute and unlawful use of a telephone. Presently before the court is defendant’s motion for a judgment of acquittal or a new trial. For reasons that follow, this motion will be denied.
