Appeals from an order and an amended order of the Supreme Court (Travers, J.), entered February 21, 1992 and February 27, 1992 in Rensselaer County, which granted plaintiffs motion for summary judgment.

The settlement of plaintiffs third-party personal injury action emanating from a work-related motor vehicle accident provided that out of the proceeds remaining, $39,215.25 be placed in an escrow account in defendant Marine Midland Bank, N.
