ORDER DENYING CERTIFICATE OF APPEALABILITY *

Petitioner Larry Fuller, a pro se 1 litigant and Colorado state prisoner, seeks a certificate of appealability (“COA”) to challenge the district court’s denial of his petition for a writ of habeas corpus pursuant to 28 U.S.C. § 2254. He also seeks leave to proceed on appeal in forma pauperis. Exercising jurisdiction under 28 U.S.C. § 1291, we deny both requests and dismiss this matter.

I.BACKGROUND
