This is an appeal from an order overruling a motion filed under Rule 27.26, V. A.M.R., to vacate sentence and judgment for stealing. (Sec. 560.161, subd. 2, RSMo 1969, V.A.M.S.)
Appellant, James McBride, pleaded guilty to a charge of stealing on May 4, 1964. April 27, 1965, appellant was sentenced on said plea to ten years’ imprisonment in the Department of Corrections of the State of Missouri.
