ORDER

LAUGHREY, District Judge.

Pending before me are Defendant’s Motion to Dismiss and Motion for Sanctions, Plaintiffs Oppositions and Suggestions in Support, Plaintiffs Suggestions in Opposition to Summary Judgment and Defendant’s Sur-Reply. Defendant requests dismissal of Plaintiffs Complaint pursuant to Fed. R. Civ. P. 12(b)(6) based on collateral estoppel and a prior release. The Court notified the parties that it would treat the Motion to Dismiss as a motion for summary judgment and granted the parties time to file additional materials.
