The Court of Civil Appeals for the Third Supreme Judicial District has certified to this court the following-statement and question:

“A. Gr. McAdams brought this suit against Housewright, Swayze & Co. and certain other defendants who have not appealed, to recover upon an account for lumber furnished for the construction- of a house and to foreclose an alleged lien upon the house. The record shows House-wright, Swayze & Co. to be the beneficial owners of certain town lots. They caused a contract to be made with J. F. Berry for the construction of a storehouse on said…
