MEMORANDUM OPINION

CHILSON, District Judge.

This matter came on for trial to the Court on July 7 and 8, 1969. After hearing the evidence, the matter was continued for the filing of briefs. The Court is now duly advised.

Plaintiff is a Utah corporation engaged in the business of making livestock and agricultural loans. In January 1966, the plaintiff approved a loan to Mr. and Mrs. Quinn J. Chlarson (Chlarsons) of Honeyville, Utah, for $73,790.00 to be used by the Chlarsons for the purchase of cattle. The loan was evidenced by a promissory note and was secured by a security interest in Chlarsons…
