In count I of an information defendant was charged with an assault with a deadly weapon upon Dallas L. Barnes, a peace officer, in violation of Penal Code section 245, subdivision (b).1 In count II defendant was charged with the commission of the same offense upon Roger L. Gripe, a peace officer. It was further alleged that, at the time of the commission of each offense, defendant used a firearm, to-wit, a revolver.
