This CPLR article 78 proceeding involves a challenge to the reapportionment of the Niagara County Legislature based on 1980 census data. At issue is whether the Niagara County (County) reapportionment plan, as reflected in proposed Local Law No. 2 of Niagara County (1981) was (1) prepared in violation of the Municipal Home Rule Law (§ 10, subd 1, par [ii], subpar a, cl [13], subcl [c]), which requires utilization of “the latest statistical information obtainable from an official enumeration”, (2) planned at closed meetings in violation of the Open Meetings Law…
