— This action was instituted by appellant, as plain- - tiff, against respondents, as defendants, to recover damages for per simal injuries sustained by plaintiff because of alleged negligence of defendants. A trial before the court and a jury resulted in a verdict in favor of plaintiff in the sum of $4000, but the court sustained defendants’ motion for a new trial. From the order granting a new trial plaintiff duly appealed.
