The questions for consideration by the court are the correctness of the following two orders of the circuit court of Alexander county. On November 9, 1943, upon separate motions of the appellees, the circuit court ordered the appellants, and each of them to make and file their election on or before November 24, 1943, as to whether they will proceed at law or in equity for damages growing out of the cause of action alleged.
