The plaintiff has instituted this action against the testamentary '’executor of her late tutor, CJmstojohe Hijmel* deceased, for the purpose of com*36pelling him to render an account of the tutorship, and to pay over to her the amount of her inheritances from the successions of her grandfather, her mother, and her uncle, which she avers were either received by her tutor or lost by his neglect.
