Appeal from an order of the superior court for Pierce county, Clifford, J., entered January 15, 1924, dismissing a petition for the appointment of an administrator, after a hearing before the court.

-Appellant filed his petition in the court below alleging the death of Edward Miller, Sr., intestate ; that he left estate in Pierce county, Washington, consisting of certain described real estate, and approximately 3,000 shares of the capital stock of the Edward Miller Cornice & Roofing Company, a corporation, of the approximate value of $150,000, and left surviving him a widow and three sons, all over the age of twenty-one years. The petition further recites:

“That your petitioner is one of the principal creditors of the said deceased in that said deceased, during his lifetime, held in trust…
