The parties to this appeal will be respectively designated as plaintiff and defendant, the titular description of them in the trial court.

The defendant at the time of the occurrence in question was engaged in constructing a building for the Western Electric Company at Clinton and Harrison streets, Chicago, and the plaintiff, a laborer in its employ, had been engaged in mixing mortar in the basement of the incompleted structure for sevéral weeks prior to the accident.
