HARRIS, Judge.

Appellant was convicted of murder in the second degree and his punishment fixed at twenty years imprisonment in the penitentiary. Prior to arraignment it was ascertained that appellant was unable to employ counsel and the court appointed a lawyer to represent and defend him in the court helow, and he is represented on this appeal by the same lawyer. This case was argued and submitted on January 25, 1973.
