Appeal from a -judgment rendered in the Municipal" Court of the City of Hew York, borough of Manhattan, sixth district, in favor of the defendant. .

On the 7th day of May, 1891, the plaintiff’s assignor sold -and. delivered certain goods to the -defendant, for which the latter agreed to pay the sum of $155.50. At the same time a statement of the account was mailed to the defendant, showing an indebtedness for the above amount. Ho part of the sum having been paid, this action was brought to recover the -debt. The defense is the Statute of Limitations, and unless -the plaintiff is able to show an acknowledgment of the debt in writing within six years prior to the commencement of the action, the plea must be sustained.
