Appeal from a judgment of the County Court of Albany County, rendered October 18, 1977, upon a verdict convicting defendant of the crimes of criminal possession of stolen property in the second degree and criminal trespass in the third degree. Defendant was indicted on charges of burglary in the third degree (Penal Law, § 140.20) and criminal possession of stolen property in the second degree (Penal Law, § 165.45, subd 1).
