In September, 1904, plaintiff brought suit in the circuit court of Jackson county having for *518its object to ascertain and determine the estate, title and interest of plaintiff and defendant, respectively, in certain parcels or tracts of land, all included in the general description of southeast quarter of the northeast quarter of section 28, township 48, range 33, in said county, and to define and adjudge such title, estate- and interest.
