Defendants, James McGhee and Rochester Lowe, were indicted for battery, resisting arrest and aggravated battery. After a bench trial, they were found guilty of aggravated battery. Defendant McGhee was sentenced to 2 years’ probation and defendant Lowe was sentenced to 5 years’ probation, with the first 90 days to be served in the Work Release Program of the Cook County Department of Correction. On appeal, defendants contend that they were not proven guilty beyond a reasonable doubt, and alternatively defendant Lowe contends that his sentence is excessive.
