The appellee National Bank, as assignee of the Gerlaeh Mercantile Company, sued the appellant insurance company, together with the Gerlaeh Mercantile Company, in the county court of Hemphill county, on a fire insurance policy. It is alleged that the Merchants’ Reciprocal Underwriters of Dallas, Tex., were doing an insurance business in the state of Texas, with an office in Dallas county, Tex., in the city of Dallas, with Edward T.
