Technology Lending Partners LLC and Nueces Financial Corporation (“the Lenders”) appeal the district court’s dismissal of their appeal of the bankruptcy court’s approval of a settlement order. The Lenders argue that the district court improperly applied the doctrine of equitable mootness to dismiss. Because the case was resolved on this threshold mootness issue, the district court was never called upon to decide whether the Lenders’ state-law tort claims were part of the bankruptcy estate.
