This appeal arises out of a personal injury suit involving a tree cutting accident. The jury returned a verdict for plaintiff David L. Ogden, Sr. in the sum of $30,000.00 and for plaintiff Marian Ogden in the sum of $4,000.00. The trial court sustained defendant’s motion for judgment in accordance with his motion for a directed verdict and entered judgment for defendant with an alternative order granting defendant’s motion for a new trial on the ground that the verdict was against the weight of the evidence.
